Terms of Service for TaskKit

Effective Date: October 18, 2026  •  Last Updated: October 18, 2026

Welcome to TaskKit! These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Zerqon Labs ("TaskKit," "we," "us," or "our") governing your download, access, and use of the TaskKit mobile application (iOS Bundle ID: com.TaskKit.app, Android Package: com.taskkit.app), home-screen widgets, AI companion features, and related services (collectively, the "Service").

By creating an account, starting a free trial, purchasing a subscription, or otherwise accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.

1. Description of the Service

TaskKit is a gamified daily routine planner, focus tracker, reflection journal, and AI-assisted productivity companion designed to help users organize schedules, break down tasks into manageable steps, and stay motivated through a virtual companion sanctuary. Key features include:

2. CRITICAL MEDICAL, MENTAL HEALTH & LIFE-SAFETY DISCLAIMER

PLEASE READ THIS SECTION CAREFULLY.

  1. Not Medical or Clinical Advice: TaskKit—including the TaskKit Companion AI chat, Mind Journal, breathing exercises, and routine suggestions—is strictly a self-help productivity and organizational tool. TaskKit is NOT a healthcare provider, medical device, psychiatrist, psychologist, or licensed therapist.
  2. No Diagnosis or Treatment: Nothing within the Service should be construed as medical advice, clinical diagnosis, psychotherapy, Cognitive Behavioral Therapy (CBT) treatment, or treatment for Attention-Deficit/Hyperactivity Disorder (ADHD), anxiety, depression, or any other medical or mental health condition. Never disregard, avoid, or delay obtaining professional medical or mental health advice from a qualified healthcare provider because of something you read or generated within TaskKit.
  3. Not an Emergency or Crisis Service: TaskKit is not monitored by human professionals and cannot intervene in real-world emergencies. Although TaskKit includes automated client-side guardrails designed to display helpline links when certain crisis keywords are detected, you must never rely on TaskKit for crisis support.
    • If you are experiencing thoughts of suicide, self-harm, or a medical or mental health emergency: Immediately call your local emergency services (e.g., 911 in the US/Canada, 999 in the UK, 112 in Europe), call or text the Suicide & Crisis Lifeline at 988 (US & Canada), text HOME to 741741 (Crisis Text Line), or visit findahelpline.com for free, confidential 24/7 support from a real person.

3. Eligibility & User Accounts

  1. Age Requirement: You must be at least 13 years old (or the minimum legal age required to consent to digital services in your country of residence) to use TaskKit. If you are under 18, you represent that you have your parent or legal guardian's permission to use the Service and that they have agreed to these Terms on your behalf.
  2. Account Security: When you register an account using your email address and password, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
  3. Guest Mode Limitation: If you choose to use TaskKit without registering an email account, your progress and data may be tied solely to your local device storage. We are not responsible for lost tasks, chat history, or companion progress resulting from device loss, app uninstallation, or operating system resets while using Guest Mode.

4. Subscriptions, Free Trials & Billing ("TaskKit Plus")

TaskKit offers both free features and paid auto-renewing subscription plans ("TaskKit Plus" / "Pro") managed via Apple App Store, Google Play Store, and RevenueCat.

  1. Billing & Auto-Renewal: When you purchase a subscription, payment will be charged to your Apple ID or Google Play account upon confirmation of purchase (or at the conclusion of any applicable free trial period). Subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless auto-renew is turned off at least 24 hours before the end of the current period.
  2. Free Trials: We may offer a free trial period for new subscribers. Unless you cancel your subscription in your Apple App Store or Google Play Store account settings at least 24 hours before the trial expires, you will automatically be charged the applicable subscription price displayed on the paywall. Any unused portion of a free trial period will be forfeited if you purchase a subscription before the trial ends.
  3. Managing & Canceling Subscriptions: Because all payments are processed directly by Apple or Google, TaskKit cannot cancel subscriptions or issue refunds directly. Uninstalling the app does not cancel your subscription.
    • On iOS: Go to Settings > [Your Name] > Subscriptions, select TaskKit, and tap Cancel Subscription.
    • On Android: Open the Google Play Store > Profile Icon > Payments & subscriptions > Subscriptions, select TaskKit, and tap Cancel subscription.
  4. Refunds: All purchases are final and non-refundable, except as required by applicable law or as permitted under the refund policies of the Apple App Store or Google Play Store. To request a refund, please contact Apple Support or Google Play Support directly.
  5. Virtual Progression & Cosmetics: Experience points (XP), companion levels, badges, background auras, and accessories unlocked in the Pet Sanctuary have no real-world monetary value, cannot be exchanged for cash, and are licensed to you solely for personal entertainment within the Service.

5. AI Companion Usage & Limitations

  1. Nature of Generative AI: TaskKit Companion utilizes third-party artificial intelligence models (powered by DeepSeek) to generate responses, suggest routines, and execute in-app tools (such as schedule_tasks and save_chat_summary). AI outputs are generated probabilistically and may occasionally be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and verifying any scheduled dates, deadlines, or advice generated by the AI.
  2. Usage Limits & Guardrails: To ensure service stability and prevent abuse, we enforce automated rate limits (e.g., maximum messages per minute), sliding-window context limits, task batch caps (up to 5 tasks per tool call), and date boundaries (preventing past-date scheduling or scheduling more than 365 days in the future).
  3. Acceptable Use of AI: TaskKit Companion is strictly an executive-function and task-planning assistant. You agree not to use the chat interface to:
    • Attempt prompt injection, jailbreaking, or bypassing system safety instructions;
    • Generate code, academic essays, spam, or unlawful content;
    • Automatedly scrape, flood, or abuse our backend Edge Functions.

6. User Content & Intellectual Property

  1. Your Content: You retain full ownership of the tasks, schedules, Mind Journal reflections, and chat messages you input into TaskKit ("User Content"). By using the Service, you grant TaskKit a limited, non-exclusive, royalty-free license to host, store, transmit, and process your User Content solely as necessary to provide and improve the Service for you.
  2. TaskKit Intellectual Property: All rights, title, and interest in and to the TaskKit application—including its software code, visual design, custom Skia aura shaders, mascot animations/videos, badge illustrations, widget designs, trademarks, and logos—are owned exclusively by Zerqon Labs and its licensors. You may not copy, modify, reverse-engineer, decompile, distribute, or create derivative works from any part of the Service without our prior written consent.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ZERQON LABS, TASKKIT, ITS FOUNDERS, DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, MISSED DEADLINES, OR EMOTIONAL DISTRESS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US FOR TASKKIT SUBSCRIPTIONS IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

9. Apple App Store Additional Terms (EULA)

If you download TaskKit from the Apple App Store, you acknowledge and agree that:

  1. These Terms are concluded between you and Zerqon Labs only, and not with Apple Inc. ("Apple"). Zerqon Labs, not Apple, is solely responsible for the App and its content.
  2. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
  3. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  4. Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
  5. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, abused our API/AI infrastructure, or engaged in fraudulent activity. You may terminate your agreement with us at any time by canceling any active subscriptions, deleting your account, and uninstalling the App.

11. Changes to These Terms

We may revise these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this document. Your continued use of TaskKit after the revised Terms become effective constitutes your acceptance of the updated Terms.
